1. Agreement to Terms

By accessing and using CallViaQR services, you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access our services.

2. Services Description

CallViaQR provides a smart vehicle contact system that allows vehicle owners to share their contact information through QR codes. Our services include:

  • Vehicle registration and QR code generation
  • Free basic contact service (calls and WhatsApp)
  • Premium plan with unlimited vehicles and priority support
  • Downloadable business cards with QR codes for vehicle stickers
  • Privacy-protected contact sharing without exposing mobile numbers
  • Emergency contact notifications
  • Vehicle management dashboard

3. Service Plans

CallViaQR offers different service plans to meet varying user needs:

3.1 Free Service: Our basic service is available at no cost, allowing users to register vehicles and use QR code contact features. Free service may have limitations on the number of vehicles or features available.

3.2 Paid Subscription Plans: We offer various paid subscription plans with enhanced features, increased vehicle limits, and additional benefits. Subscription plans may include:

  • Increased or unlimited vehicle registration capacity
  • Priority customer support
  • Advanced customization options
  • Additional features and benefits as described in the plan details
  • Early access to new features

3.3 Plan Details: Current plan features, pricing, and vehicle limits are displayed on our pricing page. We reserve the right to modify, add, or remove plans and features with reasonable notice to users.

4. Pricing & Payment Terms

4.1 Free Service: Our basic service is available at no cost with features as described on our pricing page. Free service may have limitations which are subject to change.

4.2 Paid Subscriptions:

  • Subscription pricing and billing cycles are displayed on our pricing page at the time of purchase
  • Subscriptions automatically renew at the end of each billing period unless cancelled
  • You can cancel anytime - no long-term commitments required
  • Service activates immediately upon successful payment
  • We reserve the right to modify pricing with 30 days notice to existing subscribers

4.3 Payment Methods:

  • Credit/Debit cards
  • UPI payments
  • Net banking
  • Digital wallets
  • Other payment methods as available on our platform

4.4 Auto-Renewal: Paid subscriptions automatically renew at the end of each billing period. You can cancel anytime from your dashboard before the next billing date to avoid charges.

5. Refund Policy

5.1 Subscription Refunds:

  • If you cancel within 7 days of subscribing and haven't used paid features extensively, you may request a full refund
  • Refunds are processed within 7-10 business days to the original payment method
  • After 7 days, no refunds are provided for the current billing period, but you can cancel to avoid future charges
  • Refund eligibility is determined on a case-by-case basis considering usage and circumstances

5.2 Service Interruptions:

  • If our service is unavailable for more than 24 consecutive hours due to our fault, paid subscribers may receive a proportional credit or refund
  • Scheduled maintenance notifications will be provided in advance when possible

5.3 No Refunds For:

  • Free service users (as the service is provided at no cost)
  • Partial billing periods after cancellation
  • Service interruptions caused by user error, third-party services, or force majeure
  • Change of mind after the 7-day refund window
  • Violation of Terms of Service resulting in account termination

6. Intellectual Property Rights

6.1 User Content: You retain all rights to your vehicle information, photos, and contact details uploaded to CallViaQR.

6.2 CallViaQR Rights: CallViaQR platform, QR code generation system, business card designs, and all software components remain the exclusive property of CallViaQR.

6.3 License Grant: We grant you a limited, non-exclusive license to use our service and download business cards for personal vehicle use only.

6.4 Restrictions: You may not:

  • Resell, redistribute, or commercialize our QR codes or business cards
  • Reverse engineer or copy our platform
  • Remove CallViaQR branding from business cards or QR codes

7. Acceptable Use Policy

Users agree NOT to use CallViaQR for:

  • Harassment, stalking, or threatening others
  • Fraudulent or illegal activities
  • Spamming or unsolicited marketing
  • Sharing false or misleading vehicle information
  • Violating others' privacy or rights
  • Attempting to bypass security measures or access controls

Consequences: Violation of this policy may result in immediate account suspension or termination without refund.

8. User Responsibilities

Users agree to:

  • Provide accurate vehicle information and contact details
  • Keep account credentials secure and confidential
  • Update vehicle information promptly when changes occur
  • Use the service responsibly and legally
  • Install business cards/QR codes on their own vehicles only
  • Not share or transfer QR codes to unauthorized parties
  • Respond to legitimate contact requests in good faith

9. Account Management

9.1 Account Updates: You can update vehicle information, contact preferences, and account settings anytime from your dashboard.

9.2 Subscription Changes:

  • Upgrades: Instant activation upon successful payment with access to enhanced features
  • Downgrades: Effective at end of current billing period; you retain paid features until then
  • Cancellation: Can be done anytime from your dashboard; paid features remain active until the end of the current billing period
  • Plan modifications may result in prorated charges or credits as applicable

9.3 Service Updates: We regularly improve CallViaQR with new features and enhancements. Major changes will be communicated via email or dashboard notifications.

10. Service Availability & Support

10.1 Service Uptime: We strive for 99.5% uptime but cannot guarantee uninterrupted service. Scheduled maintenance will be announced in advance.

10.2 Customer Support:

  • Free Service: Email support with standard response times
  • Paid Subscriptions: Enhanced support with faster response times and additional support channels as per plan benefits
  • Support channels may include email, phone, and WhatsApp depending on your subscription level
  • Specific support response times and channels are outlined in your subscription plan details

10.3 Technical Issues: Report bugs or technical problems through your dashboard or contact support. We'll work to resolve issues promptly.

11. Privacy & Data Protection

We are committed to protecting your privacy:

  • Your mobile number is never displayed publicly on QR codes
  • Contact requests are routed through our secure system
  • Vehicle information is stored securely with encryption
  • We never sell or share your personal data with third parties
  • You can delete your account and all data anytime

12. Limitation of Liability

CallViaQR's liability is limited to the total amount paid for subscription services in the past 12 months. For free service users, our liability is limited to ₹1000. We are not liable for:

  • Misuse of QR codes by others
  • Damages to vehicles or property
  • Lost opportunities or communications due to service interruptions
  • Disputes between vehicle owners and persons contacting them
  • Unauthorized access resulting from user negligence
  • Third-party payment gateway or SMS service failures

13. Account Termination

13.1 User Termination: You may delete your account anytime from dashboard settings. All your data will be permanently removed within 30 days.

13.2 CallViaQR Termination: We reserve the right to suspend or terminate accounts for:

  • Violation of Terms of Service or Acceptable Use Policy
  • Fraudulent activity or payment disputes
  • Prolonged inactivity (free accounts after 2 years)
  • Legal requirements or court orders

13.3 Effect of Termination: Upon termination, all QR codes will be deactivated, and access to paid subscription features will cease immediately. Any unused portion of paid subscriptions is non-refundable unless otherwise stated in our refund policy.

14. Dispute Resolution

Any disputes will be resolved through:

  • Good-faith negotiation between parties
  • Mediation if negotiation fails
  • Arbitration in Gujarat, India as final resort

15. Governing Law

These terms are governed by the laws of India. Jurisdiction for any disputes is Gujarat, India.

16. Changes to Terms

We reserve the right to modify these terms. Clients will be notified of significant changes. Continued use constitutes acceptance of modified terms.

By using CallViaQR services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
